Judge Aileen Cannon on Tuesday afternoon indefinitely postponed Jack Smith’s classified documents trial against Trump. She had already postponed a critical evidentiary hearing set for May 9th before the tampering was reported. Now, the previous trial date set for May 20th is postponed indefinitely, and it could be months before a new trial date can be set, if at all. On Tuesday afternoon, Judge Cannon set a second set of pre-trial deadlines to manage pending discovery and disclosure matters.
Judge Cannon wrote the following:
“The Court also determines that finalization of a trial date at this juncture—before resolution of the myriad and interconnected pre-trial and CIPA issues remaining and forthcoming—would be imprudent and inconsistent with the Court’s duty to fully and fairly consider the various pending pre-trial motions before the Court, critical CIPA issues, and additional pretrial and trial preparations necessary to present this case to a jury. The Court therefore vacates the current May 20, 2024, trial date (and associated calendar call), to be reset by separate order following resolution of the matters before the Court, consistent with Defendants’ right to due process and the public’s interest in the fair and efficient administration of justice.”
Judge Cannon set hearings on key motions, including Walt Nauta’s motion to dismiss for selective and vindictive prosecution. Additionally, a June 21 hearing was set on Trump’s motion to dismiss the indictment based on the unlawful appointment and funding of Special Counsel Jack Smith. In a motion filed late Friday, Jack Smith admitted the FBI messed with the boxes containing “classified” documents they seized from Trump and cannot be sure of the order or placement of the documents.
According to a footnote in the motion reviewed by The Gateway Pundit, the FBI messed with the boxes containing the ‘classified’ documents they seized from Trump’s Mar-a-Lago estate.

The DOJ in August 2022 lied to the Court when they claimed the red, blue and yellow sheets shown in the viral photo of the classified documents indicated their classification status.
The FBI admitted they messed with Trump’s documents! The FBI used cover sheets as placeholders for the classified documents.
“After the boxes were brought to WFO, the FBI created an index to correlate the documents with classification markings to codes (e.g., document “bb”) and labeled the classified cover sheets in the boxes with the codes for the seized documents. The FBI also generally replaced the handwritten sheets with classified cover sheets annotated with the index code, but regardless, any handwritten sheets that currently remain in the boxes do not represent additional classified documents—they were just not removed when the classified cover sheets with the index code were added. In many but not all instances, the FBI was able to determine which document with classification markings corresponded to a particular placeholder sheet.”
