House Oversight Chairman James Comer says Joe Biden’s mental decline might not just be embarrassing. It might make some of his pardons and executive orders… illegal.
Why?
Because Biden’s own staff can’t prove he even knew what he was signing.
Here’s what Comer had to say:
“It’s questionable whether or not it’s legal to use an autopen on a legal document, but what’s not questionable is if the President of the United States had no idea what was being signed with using the autopen in his name. Then, you know, that’s not legal.”
Think about that for a second. We’re not just talking about a pen machine. We’re talking about the President of the United States with zero clue what’s being signed in his name.
VISIT OUR YOUTUBE CHANNELComer says the problem really took off right after Biden’s infamous summer 2024 debate. You remember that one. The moment the country collectively said, “Oh… oh no.”
“I think at the end of the day, our investigation … could be used as evidence in trying to overturn some of those pardons and some of the executive orders, because the autopen was used so frequently … after that debate,” Comer said.
Even Alan Dershowitz, who’s not exactly a MAGA firebrand, says this is going to court.
“They will end up in court, and there are going to be two issues. One, the nature of what was signed – was it a pardon, or was it a bill from Congress, for example. And second, the nature of the autopen,” Dershowitz said.
Then he walks through the Constitution:
“First, the nature of what’s signed. If it was a bill, here’s what the Constitution says: ‘If he approves, he shall sign it.’ So it says, ‘sign it.’ Sign it. So an autopen would raise a real problem if he signed it by autopen, which is not a real signature.” And don’t forget it says “he” shall sign it. Even in the crazy times during the Biden administration, I don’t think even the most radical left-wing lunatic would try to claim that an autopen has a gender.
And on pardons, Dershowitz points out the obvious question: “Did he actually pardon? Or did somebody else just write the signature without really getting approval from President Biden? You know, we know there were mental health issues there. So there the issue will be: Did he approve the pardon?”
Joe Biden allegedly signed more than 8,000 pardons. Eight. Thousand.
Does anyone, anywhere in the known universe, honestly believe he sat down with even a third of those cases… combed through the paperwork… read the pleas… weighed the facts… and came to some careful, reasoned conclusion?
Please.
Every time Biden walked on stage, he looked like a confused old man trying to find the bathroom at a wedding reception. And we’re supposed to believe he was poring over legal documents with the wisdom of Solomon? Not a chance. Most of those pardons, if we’re being honest, he probably never even saw.
Even David Axelrod, Obama’s top political guy, couldn’t sugarcoat it:
“I think there was a sense of shock actually, how he came out at the beginning of this debate. He seemed a little disoriented. He did get stronger as the debate went on. By that time, I think the panic had set in and I think … there are gonna be discussions about whether he should continue.”
A month later, Biden dropped out and handed the nomination to Kamala Harris.
Republicans had been raising red flags about Biden’s mental health for years. The White House kept him hidden, controlled his access to the press, and prayed no one noticed. But Robert Hur, the DOJ special counsel, noticed.
Hur decided against charging Biden over the mishandled classified documents. Why?
In part, he said, because of Biden’s memory.
“We have also considered that, at trial, Mr. Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory,” Hur wrote.
Hur even said Biden couldn’t remember the years he was vice president… or the year his son Beau died.
After Biden left office, Comer dug in. He started investigating how senior officials covered for Biden and how the autopen became the president’s stand-in signature machine for everything from executive orders to pardons.
“The evidence, it shows at the least, that Joe Biden really didn’t know what was being done with those executive orders. He admitted to the New York Times that he didn’t look, himself, at all those pardons, that he delegated that to staff. Well, that implicated himself,” Comer said.
“And I think that you know, at the end of the day, these Biden inner circle people haven’t been able to prove that Joe Biden knew what was being signed with his autopen,” he continued.
Neera Tanden, remember her? She testified that she oversaw autopen use but didn’t know who in Biden’s circle was actually approving it.
“Ms. Tanden testified that she had minimal interaction with President Biden, despite wielding tremendous authority. She explained that to obtain approval for autopen signatures, she would send decision memos to members of the president’s inner circle and had no visibility of what occurred between sending the memo and receiving it back with approval. Her testimony raises serious questions about who was really calling the shots in the Biden White House amid the president’s obvious decline,” Comer said.
Other aides were hauled in: Biden’s doctor, his chief of staff, and senior advisers. Many refused to answer questions because that’s how people react when they have nothing to hide.
Biden, of course, defended the autopen, probably after someone made him memorize what to say. He let the New York Times know that he “made every decision.” The paper reported that Biden “did not individually approve each name for the categorical pardons that applied to large numbers of people, he and aides confirmed.”
And then the Fifth Amendment tour began.
Dr. Kevin O’Conner. Annie Tomasini. Anthony Bernal. All took it. It’s funny how Democrats say that non Democrats pleading the 5th are hiding their guilt, but when they do it, it’s just using their constitutional rights as if no one but Democrats has constitutional rights.
“These Biden inner circle people haven’t been able to prove that Joe Biden knew what was being signed with his autopen,” Comer said. “Remember, about half the people we brought in have pled the Fifth and again … when you asked Dr O’Connor, the White House physician, a question, the very first question, were you ever told to lie about President Joe Biden’s health? And he can’t answer that. He has to plead the Fifth Amendment to avoid self-incrimination.
