As thousands continue crossing the southern border into Texas, Governor Greg Abbott has signed legislation to crack down on illegal immigration in the state. This controversial move empowers local law enforcement to arrest migrants suspected of entering illegally.
The Lone Star State, known for its fierce independence, is once again at the forefront of a national debate. Governor Abbott’s decision, while drawing applause from some quarters, has also raised eyebrows and raised concerns among others, highlighting the delicate balance between national security and humanitarian considerations. The Biden administration has demonstrated that it has no problem whatsoever creating a humanitarian crisis, as the southern border has been in crisis since January 20, 2021, when Biden was inaugurated.
We expect the Biden administration to fight Texas in court the same way the Obama administration did when Arizona passed a similar law. The argument made then and that the Biden administration will make now is that according to the Constitution, the federal government has sole authority over immigration laws. Article I, Section 8, stipulates that the Congress has the power “To establish an uniform Rule of Naturalization.” And just like the Obama administration, the Biden administration is doing nothing to enforce that power. We have immigration laws on the books, but for some reason, Democratic administrations love to claim they have all the power over immigration while doing a horrific job of enforcing that power.
The New Law
The law makes trespassing charges possible for migrants crossing private land to avoid Border Patrol checkpoints. Police can also check immigration status during routine stops, like traffic violations. Supporters argue the measure is necessary to “stop the tidal wave of illegal entry into Texas.”
It has been reported that over 10 million illegal migrants have been allowed to cross our southern border illegally and roam the interior of the country with no worry of being arrested. The Biden administration has no sympathy for the harm that the flow of illegal immigrants is causing to American citizens. It has a dark mission. Some say it is to replace the usual constituent groups the party has taken for granted for decades but has now fallen out of favor with illegals. The Democrats will soon force a general amnesty for the tens of millions of illegals who have been in the country for years, making them eligible to vote and thus turning the entire United States into California overnight; a one-party country, Democratic.
Critics warn the law could lead to racial profiling and distrust between police and immigrant communities. Several activist groups have already vowed legal challenges. Of course, the pro-criminal migrant crowd is going to complain about racial profiling. It’s what they always do. In the immortal words of Vivek Ramaswamy, they should just STFU.

Texas continues to face a surge of migrants arriving from countries like Venezuela. The state’s Republican leadership blames President Biden’s border policies for driving the spike. This year, authorities have already apprehended over 2.2 million migrants crossing the southern border—a new record.
Abbott positioned the bill signing as part of his $4 billion border security push. Other major planks include building border fencing and busing migrants to Democrat-led cities. Of course, the Democrats running those sanctuary cities have gone on to blame Governor Abbot and not President Joe Biden. With Abbott facing re-election next year, the issue offers him a prime cultural war battleground.
Nationally, the partisan divide on immigration remains stark. Republicans favor aggressive border enforcement to limit new arrivals while pushing for immigrants to go through legal channels to enter the country. Democrats advocate revamping legal pathways for workers and those fleeing danger abroad. Finding common ground looks unlikely as the election season heats up.
