Judge Aileen Cannon presided over the Department of Justice’s recent victory in the DC appellate court, a highly anticipated decision. On Tuesday, she partially agreed to Trump’s desire to publish certain discovery materials, in contrast to Jack Smith’s preference for their secrecy.
Concurrently, the Court of Appeals for the D.C. Circuit denied Trump’s request to have his federal election interference lawsuit dismissed, arguing that presidential immunity does not apply.
In Florida, Judge Cannon made the critical decision to divulge particular discovery items that Smith had sought to withhold, emphasizing the “robust presumption of public access in criminal proceedings.”
“Following an independent review of the motion and the full record, the Court determines, with limited exceptions as detailed below, that the Special Counsel has not set forth a sufficient factual or legal basis warranting deviation from the strong presumption in favor of public access to the records at issue,” Cannon wrote in his opinion.
Trump nominated Cannon, a judge on the United States District Court for the Southern District of Florida, and the Senate confirmed his appointment. She was sworn in as a judge in 2020.
Smith’s goal was to protect material that could reveal the identity or personal identifying information of possible witnesses, or that could raise issues about witness safety and intimidation.
VISIT OUR YOUTUBE CHANNEL“Although substantiated witness safety and intimidation concerns can form a valid basis for overriding the strong presumption in favor of public access, the Special Counsel’s sparse and undifferentiated response fails to provide the Court with the necessary factual basis to justify sealing,” she wrote in her brief.
“Notwithstanding the conventional filing procedure outlined in Local Rule 5.4(c), there shall be no filing under seal of any unclassified material in this case unless the party seeking to make a filing under full or partial seal first has sought and obtained permission from the Court through a motion for leave to file under seal,” according to the ruling.
“The motion for leave shall be filed publicly except in clear and supported cases of risk to personal safety or national security.”
Cannon rose to national recognition as a result of her role in the high-profile court case involving former President Donald Trump.
This relates to Trump's request to unredact some information the defense obtained thru discovery productions and FOIA responses. Jack Smith basically opposed unsealing anything.

More specifically, she was assigned to supervise legal affairs related to the FBI’s investigation of Trump’s Mar-a-Lago home in Palm Beach, Florida, in the summer of 2022. The search was undertaken as part of an investigation into the handling of private documents.
According to the search warrant authorized by another judge, the FBI was investigating potential violations of the Presidential Records Act and the laws governing the administration of secret material.
