Democrat Rep. LaMonica McIver appeared before a judge on Wednesday to face charges of abuse and assault against ICE agents. She did not have to post bail, but she must surrender any firearms she possesses and cannot leave the country. If found guilty, which seems likely, since it is all on video, she is facing up to eight years in prison.
That’s a long time—but let’s be clear: if you do the crime, you should do the time. No one gets a free pass just because they sit in Congress or belong to the “correct” political party. If an average citizen assaulted federal officers and shouted profanities while resisting arrest, they’d be behind bars already. Accountability shouldn’t stop at the Capitol steps. Being elected doesn’t make you untouchable—it makes you responsible.

New Jersey Democratic Rep. LaMonica McIver appeared virtually before a federal judge in Newark this morning after being charged with assault, resisting arrest, and impeding federal officers.
McIver was in Washington for the appearance. She was read her rights and released on her own recognizance.
If convicted, faces eight years in prison and a $250,000 fine.

She was ordered to surrender any firearms she may own.
US Attorney Alina Habba announced federal charges against Democrat Rep. LaMonica McIver for assaulting ICE agents on Monday.
Habba said:
“Today, my office has charged Congresswoman McIver with violation of Title 18, United States Code, Section 111(a)(1) for assaulting, impeding and interfering with law enforcement.”
“No one is above the law — politicians or otherwise.”
McIver shouted:

Rep. McIver released a statement on Monday evening and said the charges against her are “purely political.” Nancy Mace has offered a resolution to remove LaMonica McIver from the House.

GOP Congresswoman Nancy Mace on Wednesday filed a resolution to expel Rep. LaMonica McIver after the Justice Department charged the Democrat with assaulting and impeding ICE agents.
Mace referenced the expulsion of GOP Rep. George Santos in her resolution.
“Mace’s resolution notes that the House has already set precedent for expelling Members charged, but not yet convicted, of serious criminal offenses, citing the expulsion of former Representative George Santos in 2023,” the press release said.
