Merrick Garland Appoints a Special Counsel on Donald Trump (who didn’t see that coming?) and Jonathan Turley Weighs In

On Friday’s “America Reports,” Fox News legal analyst Jonathan Turley said that possible obstruction charges in the Mar-a-Lago classified documents investigation seemed the “most menacing.” He was talking about Attorney General Merrick Garland’s choice of Special Counsel Jack Smith to oversee the investigations into former President Donald Trump.

Garland appointed Jack Smith as special counsel to look into obstruction charges of Donald Trump for the Mar-a-Lago documents that the FBI seized when they raided his home.

We now have established a pattern with the Democrats, the most evil party to exist in America. If you just take a look at what they have done in the past, you can figure out why they are doing this special counsel now. They know that Trump did not break any laws. Yet they fear him running on 2024 and winning.

Since the beginning of his presidency, the Democrats finagled a special counsel, Robert Mueller, to spend a couple of years doing absolutely nothing but leaking out fake damning statements intermittently that the misinformation fake news media gladly accepted and ran with, without ever questioning the legitimacy of what they were parroting for the Democrats.

When that didn’t work, they impeached Trump, twice. When both impeachments didn’t work to get rid of him, they setup the January 6, 2021 protest to fail, sending in FBI informants like Ray Epps who were inciting people to breach the Capitol building. And then they created the January 6 Committee. All of these things were done to keep the media pumping out lies about things the Democrats said Trump did.

Mark my words here, the Democrats will keep this special counsel going all the way up until Election Day 2024. If something happens to trump prior to that time, the special counsel will magically shut down.

Professor Turley said, “The attorney general referred to obstruction a couple of times. That’s really where the greatest concern probably will lie for the Trump team. I mean, the scope of this is going to contain both the January 6th riot and the election, as well as Mar-a-Lago. As I said earlier, we still have not seen a very strong basis for any criminal charges linked to the January 6 riot. On Mar-a-Lago, the past cases, even the most egregious cases, have resulted in relatively light criminal charges. That is for possessing or removing classified evidence.”

I don’t know how many times people have to point this out, but Donald Trump declassified the documents that were at Mar-a-Lago while he was still president.

The memorandum, dated January 19, 2021, titled Memorandum on Declassification of Certain Materials Related to the FBI’s Crossfire Hurricane Investigation, concerns the documents that AG Merrick Garland’s corrupt Department of Justice was looking for. They wanted to know what evidence trump had on the Obama-Biden administration when the DOJ and FBI committed crimes against Trump and members of is campaign.

So my question is, how can you obstruct something when you did nothing wrong?

In 1988, the US Supreme Court ruled on a case called Department of the Navy v. Egan. In that case, among other things, the court ruled that a president has the ultimate authority to classify and declassify anything he wants. The case has often been interpreted to support broad presidential authority over national security generally and over access to classified information in particular.

And in 2012, Obama appointed Judge Amy Berman Jackson ruled on a case called Judicial Watch v. National Archives and Records Administration. This was a case concerning secret audio tapes that then President Bill Clinton took home from the White House and kept in a sock drawer. You really can’t make these things up. Judicial Watch’s Tom Fitton wanted those tapes because he felt that the American people had a right to know what was on them. Judge Berman Jackson ruled that the president has ultimate authority on determining what is presidential records and that the National Archives does not have authority that supersedes that of the President of the United States. Therefore, what the president decided was a presidential record supersedes everything. She rightfully threw out the case.

Turley added, “That is not the case with obstruction. So when we talk about obstruction, that is something that can come and has historically come with significant penalties. So I think that the scope of this investigation is going to be a serious concern, obviously, any time a special counsel is appointed, it concentrates the mind of every attorney involved. But I think most of us are really looking still at Mar-a-Lago as where those torpedos in the water are probably most menacing.”
