Kamala Harris seems to be in a tough spot, as her latest tactics may be backfiring. In an attempt to reignite her campaign, she has put forward controversial ideas like eliminating the Senate filibuster to pass federal abortion rights legislation. This push comes as Democrats are struggling to energize their base. However, even within her party, her approach is being met with resistance. Both Senators Joe Manchin and Senator Kyrsten Sinema have publicly disagreed with Harris’ proposal, signaling discontent within the Democratic ranks.

Kamala Harris’ support for removing the filibuster smacks of desperation. But what’s more, the power to eliminate the filibuster lies with Congress, not the President or Vice President. The proposal, despite being a hot topic, seems unrealistic and detached from legislative reality. This misstep has many questioning her strategy, especially as she faces an increasingly difficult political climate.
Before I get into it, I want to point out that the US Supreme Court, in its ruling on the Dobbs case that repealed the Roe v. Wade decision from 1973, told the federal government that it has no role in abortion. In the US Constitution, under Article I, Section 8, we have what is known as the Enumerated Powers. These are the powers that the federal government got when the Constitution was ratified. They are powers that the states cannot have authority over. Under the 10th Amendment, any powers not listed in the Enumerated Powers belong to the states and the people, respectively. This means that if Article I, Section 8, does not mention a power that the federal government wants to exercise, that power automatically belongs to the states. Even powers that weren’t yet thought up. The Constitution has an amendment process that simply says if the federal government wants to take a specific power away from the states, it has to ask the states for permission in the form of an amendment. Lest we forget that abortion does not appear in Article I, Section 8’s Enumerated Powers, nor in any amendment to the constitution that has been passed since ratification. Therefore, it is my opinion that Kamala Harris and any other politician making arguments about codifying abortion law into the federal system is a complete and utter waste of time because the Supreme Court already told Kamala and the entire federal government that they have no role in abortion.
Polling data is adding to Harris’ woes. Recent surveys indicate that Donald Trump is gaining momentum. In a surprising shift, Trump is now leading Harris in key national polls, even in polls that have historically favored Democratic candidates. For instance, a Quinnipiac poll showed Trump edging ahead of Harris—a significant departure from the 2020 elections, when Joe Biden had a comfortable lead at the same point.
Adding fuel to the fire, party identification polls from Gallup reveal that the Republicans now have a slight advantage in voter identification, a key metric for predicting national outcomes. Historically, party identification trends have closely aligned with popular vote results, meaning the Republicans may be poised for a stronger showing in the 2024 elections.

Turnout in traditionally Republican districts is through the roof, with some counties seeing a 500% increase in turnout compared to 2020. This surge in voter participation, particularly among first-time voters, is seen as a promising sign for Trump’s campaign. Many of these voters are from rural areas and are classified as “low propensity voters,” a group that tends to support Trump by overwhelming margins.
What does all this mean for Kamala Harris? Her campaign seems to be struggling to maintain its footing. The push to eliminate the filibuster, aimed at rallying the Democratic base, may actually be driving away key voters. Moreover, with Trump gaining momentum and Republican voters showing up in force, Harris’ campaign faces an uphill battle.
As we head into the final stretch before the 2024 elections, Kamala Harris’ chances appear to be dimming. The signs of desperation are clear, and unless her campaign can turn things around quickly, the outlook doesn’t look promising for the Vice President. The next few weeks will be crucial in determining whether Harris can regain her footing or if her campaign will continue to falter.
In the meantime, the momentum appears to be on Trump’s side, as he rides a wave of voter enthusiasm and rising poll numbers. Whether this trend holds up in the coming months remains to be seen, but for now, Kamala Harris’ campaign is signaling a loss in the making.
